International Emergency Economic Powers Act (IEEPA) Tariff Refunds
IEEPA Tariff Refunds
In 2025 President Trump issued tariffs under the International Emergency Economic Powers Act (IEEPA). On February 20, 2026 the Supreme Court struck down these tariffs and later ruled that the tariffs received need to be refunded.
On April 20th the U.S. Customs and Border Protection opened a portal to begin processing refunds to these tariffs. What are some of the key items businesses need to know today?
Who can qualify for refunds, and what do they need to know?
- Only tariffs imposed under the IEEPA from February 2025 through February 2026 qualify for refunds
- A company must be the Importer of Record (IOR) to claim the refund.
- Refunds are expected to be processed within 60 to 90 days.
What are the next steps?
- McGuire Sponsel can review the refund potential with some limited information, including:
-
- List of entities that paid tariffs as the importer of record.
- Any financial information regarding the tariffs paid.
- Setting up a call with your McGuire Sponsel Relationship Manager to begin the process.
Why does it matter?
Time is of the essence, while the portal is open there is no guarantee how long the refunds will be processed. Please contact your McGuire Sponsel Relationship Manager for more information.
